agency action was effected, in whole or in part, because of discrimination on the basis of

Defenses for veterans often arise from so-called mixed appeals --
appeals with arguments of handicap or other discrimination factors included -- and can be
appealed to MSPB with greater opportunity for a legal finding of discrimination, rather
than taken to binding arbitration. These appeals are rather unique, due to their
presentation of both EEO and MSPB issues at the same hearing, with additional EEOC appeal
rights being granted on EEO issues if the judge denies the case at the initial
decision. Discipline arising from a service connected disability might also be reviewed
favorably under accommodation rights before a law judge. Alternatively, an actionable
disciplinary action containing EEO arguments can be appealed through both the grievance
procedure and EEO, giving the appellant two separate venues. |
